Again, Atiku’s son loses as court grants ex-wife custody of children
An Upper Area Court in Kubwa, Abuja has granted Maryam Sherif, divorced wife of Alhaji Atiku Abubakar, custody of their three children. Abubakar is the son of Nigeria’s former Vice President of the same name. Sherif, had instituted a case against Abubakar, at the High Court of the Federal Capital Territory, Gudu, Abuja, with number CV/41/2019 which was later transferred to the Upper Area Court, Kubwa, with number CV/16/20202 seeking the court to grant her custody of their three sons.
Delivering judgment, Hon. Bashir Danmaisule, ruled that in accordance with the Islamic Law, custody of the children lies to her, provided she did not remarry and consequently ordered the defendant to hand over the children to the claimant with immediate effect. The testimonies given by the five witnesses the defendant produced in the course of the trial were expunged by the judge on the grounds that the witnesses were too close to the defendant and their testimonies were biased. The plaintiff’s counsel, Nasir Saidu applauded the judgment of the court. Neither Alhaji Atiku Abubakar nor his counsel was in court.
