Appeal Court affirms Ayogu Eze as Enugu APC governorship candidate

The Abuja division of the court of Appeal has affirmed Senator Ayogu Eze as the governorship candidate of the All Progressive Congress (APC) for the forthcoming election.

The appellate court in a unanimous judgment delivered by Justice Abdul Aboki upheld the appeal filed by Mr Eze to affirm his candidacy for the poll.
In the judgment, the court set aside the decision of the Federal High Court delivered by Justice Inyang Ekwo which had earlier affirmed George Ogara as governorship candidate for APC.

Justice Aboki voided the lower court’s decision on the ground that the suit brought before the Federal had become statute barred and not competent in law having been filed outside the mandatory 14days stipulated by sec 285(9) of the 1999 constitution.

The APC had held its primaries on October 4, 2018. Ogara had on November 5, 2018, (32 days after the primaries) instituted a legal action at the court challenging the emergence of Senator Ayogu Eze as the APC governorship candidate for the 2019 general election.

The appeal court, therefore, set aside the lower court’s decision Which ordered INec to remove Eze from INEC’s list of candidate in Enugu state.
