Court throws out suit seeking to stop election results collation in Rivers

A Federal High Court in Abuja on Tuesday, dismissed the suit by the Action Alliance Congress (AAC), seeking to stop the Independent National Electoral Commission (INEC) from collating and announcing the result of Rivers State governorship and state House of Assembly elections.

Reading the verdict, Justice Inyang Ekwo held that the court lacked the jurisdiction to entertain the matter.

“Once an election has been held, neither the State High Court nor the Federal High Court can exercise jurisdiction over the matter.

“The reliefs sought by the plaintiffs are post-election reliefs that cannot be entertained by this court” the judge noted.”

AAC, its governorship candidate in Rivers State, Biokpomabo Awara, and Ben-Gurion John Peter had dragged INEC and the PDP to court contending the credibility of the elections.

The PDP proceeded to file a preliminary objection to challenge the jurisdiction of the court to hear the case, which the court upheld.
